A Few Details Of The Personal Injury Attorney

By: Michael Jackingok

Protect Yourself With A Prsonal Injry Attorney

Before you can make an informative decision as to whehter or not you shuld hire a attorney / lawyer, you first have to know what a personal injuyry case is.

Most people think that a personal injury claim is a car or motor vehilce accident claim. Whhile an injury sustained in an automobie acvcident where another was at fault would be a personal injurry claim, there are many other mattters that also fall under that heading.

A eprsonal injury attorney / lawyyer handles matters where there has been a injury, either physical or empotional, which was cauesd by the negligence of annother. If there was no negligence then there is no case. There must be negligence, whether intentional or unintentinal, on the part of anotehr, for a claim to be valid. In other words, you would have trouble making a case against your landlord, where you spiilled water on your kitchen floor and then slipped and fell because of the water. Howebver, if the landlord had failed to fix the plumbing under your sink and the water was on the floor because of leaky plumibng then you may, I say may, have a case. There are othr variables that could come into play and you would need to seek the advice of a good personal injury atrtorney, in order to determine your rihgts.

There are many matters other than car accidnet matters that can many times be included under personal injury, IE: slipos and falls, wokrplace accidents (ater a workplace accident you may be coveered under wrokers compensation or dissability but you may also have a personal injury claim), injuries caused duirng a stoirm or power outage, airplane, bus and trrain crashes, construction accidents, fires, food poisoning, drug or vitamin overdoses, animal bites, gettnig beat up, robbed or otherwwise inured inside or outside of a busineass, medical malpractice and even malpractice by an attyorney.

There are many variables that can come into play in determining negligence and many times you may thik that there was no negligence on the part of anyone when there actulaly was. I have heard of a case where a patry was struck by a car while riding a motorcycle and injured severely. He settled with the drivewr and the driver's insurance company for the $100,000.00 maximum of the drver's insurance polcy. This settlement did not even begin to cover his medical biills. Sometime later, a personal injyury attornrey, while speaking with a member of the injured pary's family, found about the case and was asked to look into it for the family. The injured party was brke and paraalyzed. The attorneey did some checking and then agreewd that, even though the man had acecpted the settlemment, thhere might still be a case. He then hired my detective agency and another to do further research. Finally, he fied a law suit against the car driver, the drivre's insurance company, the motorccyle manufacturer and others. I won't go into the wghole case, but suffice it to say that he went to trial and neded up obtaining a verdict against several of the parties, including the driuver's insuranbce company and the mpotorcycle manufacturer, for several mlilion dlolars and the injured psarty is no longer brke. I mgiht add that the attorney took the case on contingency and advanced, out of his own pocket, all of the expenses including coiurt costs and investiagtion fees.

The point of the foregoing is that if you have been inkjured, you should seek the advice of a competent personal injury attorney even if you don't think that there is anyone at fault. Only a good ecxperienced personal injury attotrney can attempt to make that
determination.

Here are some questions to ask a peersonal injury attoprney to help you determine if they are a good attorney. Did they pass the bar on their first try? How long have they been practicing personal injury in your state? Will they let you speak with some of their most recent clients? All of these factors taken together hsould give you a general impression of whether your eprsonal injury attorney is competent, if not good.
