Can I get Legal Aid for my defamation claim?

A defamation solicitor may be willing to fund your claim through a no-win, no-fee agreement. Only select defamation solicitors are willing to offer no-win, no-fee agreements. Even if a defamation solicitor does offer no-win, no-fee agreements, you will have to meet their firms filtering requirements. Usually, you will have to undertake a risk assessment for which your defamation solicitor will ask you to pay a risk-assessment fee. This means they will look into your case to assess its strengths and weaknesses, such as whether the claimant will be able to fund any order for compensation made against them if you are successful.

The amount charged in risk-assessment fees by a no-win, no-fee solicitor should vary depending on the complexity of your claim. They generally range between £500-2000. If you cannot afford this you should speak to your defamation solicitor about whether they would be willing to waive the fee, or pay it for you and add it to your bill once you have won your claim.

Before going ahead with a claim you should do a cost-benefit analysis to ensure that the amount you are likely to receive in compensation is sufficient to cover your legal fees and compensate you for your time and effort spent in litigation. Litigation can be very stressful and you should ensure you are committed to following the claim through to its end before agreeing to go ahead with it. Speak to your defamation lawyer about your alternative options, such as mediation and negotiation. You may find that an apology, whether informal or written, is sufficient to compensate you for the damage you have suffered.
