Can no win no fee lawyers help with claiming compensation for back injuries?

By: Maksiv Konta

If another person was the cause of someone’s back injury, it is possible for that person who has suffered the back injury to recover personal injury compensation from the party who negligently caused the injury. It is highly advisable for people injured by another’s negligent act or omission to obtain legal advice and help from a personal injury solicitor.

A personal injury lawyer will assess the injured party’s claim and determine if they have a reasonable chance of success. They will conduct a risk assessment to find out as much as possible about the claim and whether it is suitable for a no win no fee agreement. The risk assessment will take into consideration the evidence, witness credibility, the value of the claim, and the ability of the negligent party to pay personal injury compensation. If they are satisfied with the result of the risk assessment, a personal injury lawyer will offer to pursue the compensation claim on a no win no fee basis.

A no win no fee agreement allows the injured party to pursue their personal injury compensation claim without paying their solicitor’s fees up front. They will only be obliged to pay their solicitor’s fees if their claim is successful.

In addition to the normal fees, the successful claimant must pay their personal injury solicitor a success fee. A success fee is a percentage of the normal costs that represents the risk taken by the no win no fee solicitor for agreeing to take the claim on a no win no fee basis. However, in many personal injury cases, the successful party’s solicitor’s fees and success fee can be recovered from the other side.

Personal injury compensation for a back injury can be anywhere between £4,000 and £90,000, or more depending on the severity of the injury and the loss suffered by the injured party. A no win no fee personal injury lawyer can advise an injured party on the amount of compensation they can expect to receive. A no win no fee lawyer should be consulted as soon as possible as personal injury claims must generally be made within three years of the accident.
