Can you get free divorce advice?

Relate counsellors are available to discuss marital problems and divorce online, on the telephone or face-to-face. They can’t, however, give binding advice about divorce law. Only a qualified family law solicitor can do this.

Directgov is a government website that offers free advice on how to commence divorce proceedings. It describes the grounds for divorce and the court process. In addition, the Citizens’ Advice Bureau (CAB) provides free divorce advice. Their website contains information on divorce, and it is possible to visit a local CAB to speak to an advisor face-to-face. The CAB can also put you in touch with divorce solicitors, and other organisation that can help with family law matters.

Although the above organisations can offer a person initial advice regarding divorce, they will be unable to offer legal advice regarding divorce. Legal advice on divorce is best obtained from a professional solicitor who specialises in divorce. A divorce solicitor will be able to advise a person on their legal entitlement in regard to the divorce settlement, which grounds for divorce to cite on the divorce petition, and how to contest a divorce. Divorce law is complicated and to ensure that the divorce process is successful, the advice of a professional divorce solicitor is essential.

In addition, a divorce solicitor can offer advice regarding what will happen to children from the marriage after a divorce. For many people this is the most important issue during a divorce. The ideal situation regarding children is for the parties to a divorce to come to an agreement between themselves. However, this is not possible in all situations. Divorce solicitors can help in these situations by enabling their client to obtain residence and contact orders, or a parental responsibility order for their children. In addition, divorce solicitors can advise their clients on maintenance payments.

Legal Aid from the Legal Services Commission is available for divorce cases, and will cover all or part of a person’s legal costs if they are eligible. To be eligible for Legal Aid a person must show that are receiving benefits, or that their capital and income fall within the current financial limits.
