Can you recover compensation for injury or disability from vaccinations?

By: Maksiv Konta

While the UK government took a long time in implementing measures to assist people in gaining compensation for vaccination, it is now available for certain types of vaccinations that have resulted in certain levels of disability. You should contact a personal injury solicitor if you think you may be eligible to make a claim. A personal injury solicitor can explain how the vaccinations compensation system works, and assess the strength of your claim.

The compensation is called the Vaccine Damage Payment and the amount of compensation is set at £120,000 tax free. There are limitation periods which mean that claims have to be made within a certain period of time. If you are making a claim on behalf of a person under 18, then you need to wait until they have reached at least two years of age. Claims must be made before the disabled person reaches 21, or within six years of the date of the vaccination, if this date is later. In all cases it is highly advisable to obtain the help and advice of a personal injury solicitor to handle your case.

In order to be eligible for the Vaccine Damage Payment, you need to have been vaccinated as a child, although you can be eligible for the payment if you were vaccinated as an adult in certain situations. Personal injury lawyers can explain these situations if you want to make a claim as an adult.

For certain types of vaccinations you will be eligible regardless of when you had the vaccination. For vaccinations that take place during an outbreak of disease, you will also be eligible, even if you had the vaccination as an adult. If you are unsure if you are eligible or not, then you should contact a personal injury solicitor who will be able to advise you.

The Vaccine Damage Payment will only be made where the vaccination has resulted in severe disability and the cause of the disability can be shown to be the vaccination. There is a specific list of diseases for which damage caused by vaccination against will result in a payment being made. You should contact a personal injury solicitor for information about the types of vaccinations that will result in payment being made.
