Do conveyancing solicitors liaise with mortgage providers?

The work of a conveyancer really only starts once an offer has been made and accepted, although at this stage it is common for both sides to have a conveyancing lawyer appointed.

The seller’s conveyancing lawyer will gather title information, the Energy Performance Certificate and will produce a contract of sale. Conveyancing solicitors are also responsible for managing the financial aspects of the property transaction, holding funds to ensure that any charges against the property are discharged in the correct manner.

The buyer’s conveyancing lawyer will inspect the sale documentation and conduct searches on the property. Typical searches include the Local Authority, Land Charges and Drainage and Water searches. These searches, a building survey and the valuation are required for any mortgage secured by the buyer against the property to be purchased. A conveyancing solicitor may also act on behalf of your mortgage lender to save time and money. In this caser they will help prepare the legal documentation relating to the lending of money against the property.

Once the contracts and finance are in place the conveyancing solicitors on both sides will agree an exchange of contract. This is legally binding and commits both sides to the transaction. At this point there is some time afforded to both sides to arrange the move, prior to a completion date.

Upon completion the selling conveyancing solicitor handles the money paid, settling outstanding debts to any lenders and taking their fees, before releasing the balance to the seller.
