How do you search for copies of a will?

By: Maksiv Konta

Once a person has died, searches for the will should be made in their home and personal documents and with their solicitor. A copy of the will should be provided to the executor named in the will. They will use this copy of the will to carry out the administration of the estate, including obtaining probate, if necessary. The executor may also choose to distribute a copy of the will to beneficiaries under the will; however this is not a requirement.

If you have not received a copy of the will, you will have to wait until it has gone through probate. Once a grant of probate has been obtained, the will becomes a public document available for all to access. You can apply for a copy of the will through the Probate Registry. You may contact either the central Registry in London or the Registry servicing your area.

If you are an executor under a will, you should contact a wills and probate solicitor for advice and assistance. Administering a person's estate can be a complex exercise, as there are many things to consider. A wills and probate lawyer can prepare the documents necessary to obtain the grant of probate and undertake all other tasks required to administer the estate.

If you believe you are a beneficiary under a will but you have not been able to obtain a copy of the will, you should speak to a wills and probate solicitor to see if there is anything you can do. However, generally speaking, you will have to wait until the grant of probate has been issued.
