Understanding What Constitutes Theft

The definition of Theft may vary from one jurisdiction to another. Theft in general is defined as a crime. Theft is the intent to take another person’s good or belonging without the approval of the person who is the owner of the property. The key factor to constitute theft is the intention. So if there is no intent there can be no theft. Theft can also be considered to have been committed when it is within the knowledge of the person who is deprived off his goods. Poverty, family circumstances, mental state any one of these can be the reason for Theft.

Identity Theft

This is a modern world so the theft style will also be related to technology. The theft which is of great concern in United States is called Identity theft. This type of theft is also spreading in all countries across the world. It is likely that this crime will soon spread if proper measures are not taken. In this type of theft all the personal identification information is gained by the criminal like credit card or bank account information. In this type of theft personal information such as birth date, address, phone number and other valuable information is gathered by the thieves and is misused. Sometimes even a person whose information is being misused is not aware of it and only comes to know after the reputation of that person is destroyed. This can happen to anyone. Thus to prevent this from happening it is advisable not to give one’s personal information to any site unless and until it is the trusted one.

Shoplifting theft

Shoplifting is also considered as one type of theft in which something is stolen from the store. In order to be convicted of shoplifting, it is not necessary to leave the shop or the store. Shoplifting takes place if the price tags are removed or altered. Shoplifting also occurs when the goods are transferred from one container to the other. Even hiding the goods is considered to be shoplifting.

Penalties and Punishments

The penalties in theft are based on the amount that is stolen by a person. It can be fine or imprisonment or both depending upon the amount stolen and the place where theft took place. The higher the amount of money stolen, the penalty will be accordingly. Other important factor is where the person is convicted for such a crime for the first time or has a track record of committing this crime. Based on this the punishment will vary. Moreover, the person convicted will not have to face the court penalties but the reputation of the person may be affected. Due to this, person convicted may have to face negative employment as well as social consequences.
