What are the different types of industrial action?

By: Maksiv Konta

There are several different types of industrial action that can be taken; the main ones are listed below.

Strikes

Strikes are probably the industrial action you have heard about most. The recent controversial British Airways strikes which were contested all the way to the High Court featured prominently in the public sphere. Strikes involve absences from work, whether short-term such as a day or a couple of hours or long-term for an extended period or even indefinite period of time. Strikes can also be intermittent taking place for part of the day or week on a rolling basis but with normal working hours resuming for the rest of the working day/week.

Picketing

Picketing involves employees staging a protest at or near a workplace. The aim is to encourage awareness of their cause and to gain support from other employees, customers, or suppliers. They may form a picket line between the workplace and the outside, and endeavour to stop employees or replacement employees from entering the workplace and performing their duties. They may also prevent customers or suppliers from conducting business with the employer, which can have legal consequences.

Bans on overtime

Overtime bans may be introduced to put pressure on management. Normally if overtime is not specified in the employment contract, there is not much an employer can do about bans on overtime, but in some circumstances it may constitute a breach of contract.
Sit-ins

Employees ‘sit-in’ in their employer's premises and may refuse to leave. Employers may need to take legal proceedings seeking an injunction or an order for possession in order to get the employees out. They are advised to seek legal advice from an employment solicitor in this situation.

Lock-out

A lockout is a work stoppage in which an employer prevents employees from working. An employer might choose to do this if the employees are striking or ‘slowing down’ their work.

There are more types of industrial action. If you are considering getting involved in industrial action, you should speak to an employment solicitor. There can be consequences for your pay and job, so getting legal advice from a qualified employment solicitor is important.
