What is the law on product labelling and packaging?

By: Maksiv Konta

Certain market sectors will also have special labelling rules that your business must comply with. For instance, businesses that sell precious metals must use the hallmarking system. Shoe manufacturers must label their products with the main materials contained in the shoes. The food labelling industry has some of the most stringent rules and regulations that must be complied with. And if your business sells toys, the labelling on the packaging must meet the Toys (Safety) Regulations 1995. If you are uncertain if your goods must be labelled according to special rules, contact a commercial solicitor for legal advice.

For retailers the most important law to be aware of is the Price Marking Order 2004. The Order relates to how you should show prices on the packaging of any goods you sell. The law states that the price should be clear to the buyer. If you are at all unsure of how to approach the product labelling for your goods, a commercial solicitor can clarify the current regulations and apply these to your business.

If your company exports any goods, it is your responsibility to ensure all the labelling and packaging of its consignments meets all EU regulations, and any specific rules of the country you are exporting to. For instance, you may have to label your products in several languages, or your label may need to have a picture of the product inside. A commercial solicitor can advise you on the relevant EU regulations that will apply to the labelling and packaging of your goods if you are exporting them abroad.
