Will a conveyancing solicitor conduct searches during the conveyance process?

In the event your property is unregistered they will gather your deed of title. They will also require a copy of your Energy Performance Certificate and they will prepare a contract for sale.

If you are buying property then you will instruct a conveyancing solicitor or licensed conveyancer once your offer has been accepted. At this point your conveyancing lawyer will request the documentation mentioned above for inspection. It is commonplace for the buyer’s conveyancing solicitor to undertake a range of searches on the property in question.

The most common searches to be conducted are those of the Local Authority and Land Charges registers, and the Drainage and Water search. These are widely considered to be the minimum necessary to satisfy a mortgage provider. In many cases however your solicitor may advise procuring additional searches. This will depend on the property and the area but an environmental search is commonplace in modern conveyancing. This will show up contamination issues and will look at local flood risks. There are many other searches available, providing information on mining, church ownership and charges.

Your conveyancing solicitor may procure the searches from your local council or water board directly, or may employ the services of a personal search company.
The searches are used to gather information about the property which might not be obvious upon viewing. These include charges and covenants, as well as information on local planning matters. They provide assurance to the buyers and any prospective lender that the value of the property will be maintained in the years to come.
